Online Contract

The following contains the terms of the agreement between snaxXPRESS.com (“Company”) and the buyer (“Buyer”) of goods or services through the Company’s Web site (the “Site”).

1.      Introduction:  Buyer agrees to the terms and conditions outlined in this Online Contract ("Contract") with respect to the goods, services and information provided by or through the Site.  This Contract constitutes the entire and only agreement between the Company and Buyer, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the Site, and the subject matter of this Contract.  Buyer agrees to review this Contract prior to purchasing anything and purchase of a good or service shall be deemed acceptance of this Contract.

2.      Setup and Payment:  Buyer represents and warrants that (i) the credit card information supplied is true, correct and complete and (ii) charges incurred by the Buyer will be honored by the Buyer's credit card company and (iii) Buyer shall pay charges incurred by Buyer at the amounts in effect at the time incurred, including all applicable taxes.  Buyer shall be responsible for all charges incurred through use of Buyer's password.  Buyer agrees to keep his or her password confidential and to notify Company within 24 hours of any breach of this Contract or unauthorized use of the password.  Company does not protect Buyer from unauthorized use of Buyer's password.

3.      Copyright:  The content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a Buyer of any such content or any part of the Site is prohibited.

4.      Editing, Deleting, and Modification:  Company reserves the right in its sole discretion to edit or delete any information or content appearing on the Site and to remove any goods and services for sale.  Upon notice published over the Service, Company may modify this Contract, or prices, and may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice.  Modification of this Contract will be deemed effective upon publication on the Site with respect to transactions occurring after said date.

5.      Right to Refuse:  Company reserves the right in its sole discretion to refuse service at any time.  Sale of any goods or services is subject to availability.

6.      Indemnification:  Buyer agrees to indemnify, defend and hold Company and its affiliates, licensors and suppliers harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to a Buyer's violation of this Contract or use of the Site.

7.      Non-Transferable:  Buyer's right to use the Service is not transferable and is subject to any limits established by Company or by Buyer's credit card company.

8.      Disclaimer:  THE SERVICE, CONTENT, GOODS AND SERVICES FROM OR THROUGH THE SERVICE ARE PROVIDED "AS-IS," "AS AVAILABLE," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE).  THE SOLE AND ENTIRE MAXIMUM LIABILITY OF COMPANY, FOR ANY REASON, AND BUYER'S SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PARTICULAR ITEMS PURCHASED. COMPANY AND ANY OF ITS AFFILIATES, DEALERS OR SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND BUYER.  THIS SITE AND GOODS AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS.  SOME STATE STATUTES MAY APPLY REGARDING LIMITATION OF LIABILITY.

9.      Refund Policy  If a product purchased is defective or not to Buyer’s satisfaction, Buyer can return the product in its original condition at the time of delivery, to the delivery driver. In such event, Company shall provide Buyer a credit for the purchase from the Site (less shipping and handling charges incurred).  This Section 9 sets forth Buyer’s sole and exclusive right to refund.

10.  Use of Information.  Company reserves the right, and Buyer authorizes Company, to the use and assignment of all information regarding Buyer’s use of the Site and all information provided by Buyer, subject to applicable law.

11.  Miscellaneous.  Any cause of action of Buyer with respect to the Site must be instituted within six (6) months after any purchase or be forever waived and barred.  All actions shall be subject to the limitations set forth in Section 8. The language in this Contract shall be interpreted as to its fair meaning and not strictly for or against any party.  All legal proceedings arising out of or in connection with this Contract shall be brought solely in Regina, Saskatchewan, Canada, and Buyer expressly submits to the jurisdiction of said courts and Buyer consents to extra-territorial service of process. Should any part of this Contract be held invalid or unenforceable, that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site or the Company is in conflict or inconsistent with this Contract, this Contract shall take precedence. Failure of Company to enforce any provision of this Contract shall not be deemed a waiver of such provision nor of the right to enforce such provision.

Internet Commerce Policies and Procedures
  • All products available through our web site are consumables or household items. We do not offer prohibited products or services.
  • We provide descriptions of all products available on our site.
  • All the products we offer are brand-name, but due to legal issues the fast-food products are described on our web site under generic product names. If you are uncertain of what each generic product name means, our Customer Service Department can be contacted at
    customer-service@snaxxpress.com. We will be happy to answer any questions you may have.
  • We maintain current information and marketing messages on our site.
  • Policies arising from promotions of our company will be clearly posted at the time of promotion. All customers are subject to these policies.
  • Prices are maintained on a daily basis and are in Canadian dollars.
  • We provide both an online receipt (viewable to you immediately after your order has been authorized) and an e-mail receipt.
  • We employ the same merchant name (snaxXPRESS.COM) on both our web site and transaction receipts (online and e-mail versions).
  • When the delivery arrives at your door, you will be requested to sign a credit card slip (with zero balance) in order to receive the order. This is done to verify that each credit card is used only by the authorized credit-card holder, and that the order has been correctly delivered (see Return and Refund policies). This minimizes credit card fraud.
  • Through our banks and payment processors, we provide credit-card processing experience, technology and security.
  • Through our internet service provider and our backup computer power supplies we provide 24/7 access to our customers.
  • Our web site is audited annually by independent controllers assigned by our company's financial agents.

Product Prices
  • Fast Food Pricing
    Since the various fast food vendors have different prices for similar items, our menu prices are just a maximum possible price for each item and are used only to pre-authorize your credit card purchase. In every case, our final price will reflect the price of your chosen fast food vendor plus a 10% markup. This means that in most cases you will pay a price which is less than that listed on our menu.
  • e-Convenience Pricing
    The prices you pay for e-Convenience items are exactly as listed on our menu.
Delivery Charges
  • For an order from a single vendor, the delivery fee is $5.95 .
  • For orders from multiple vendors, there is a surcharge of $2.00 for each additional vendor.
  • Delivery fees are applied to the total order cost before taxes.
Taxes
  • Federal and provincial/state taxes are levied on the total bill, in accordance with government regulations.
Credit Card Charges
  • Online merchant credit card fees run between 3.25% and 5% depending on the credit card issuer and the bank. These are paid by snaxXPRESS.

Delivery Policy
  • Although we can not guarantee delivery times due to complicated nature of food delivery, our service is very fast. Most importantly, your food will always arrive hot, even during the lunch or supper rush.
  • The delivery fee is $4.95 for an order from a single vendor on each delivery run, and an additional $1.00 fee for purchases from each additional vendor. In other words, if you order from two vendors your delivery fee will be $5.95. We recommend pooling your order with friends or co-workers and splitting the delivery fee with them.
  • In the event of an order from multiple vendors, our drivers will make every reasonable attempt to procure the hot items last, for our customers' enjoyment. To this end we use 'snaxx bags' (special thermal food bags) to keep hot food hot and cold food cold.
  • We offer a flexible delivery address system: we can deliver to any address you specify, even if it is different than your credit card billing address. This means that you may order snacks or food and have them delivered to your home, office or to a friend. We provide instructions on how to do this at the checkout stage of your shopping.

Return and Refund Policy
  • Our shopping cart provides the customer with the opportunity to change the order or any information entered at any time during the shopping process, prior to the submission of the order. This gives the customer full control of the order and minimizes errors.
  • Due to the express nature of our service, once an order has been submitted it is not possible for the customer to stop the process, and the customer is completely responsible and financially liable for the contents and cost of the order.
  • The customer will inspect the contents of the order upon delivery and sign a credit card slip (with, zero balance) signifying acceptance of the delivery.
  • Any discrepancies or errors in the delivery products must be indicated to the delivery driver prior to signing the credit card slip.
  • When a refund is warranted and upon decline of the order by the customer, the customer's credit card will be reimbursed on the next business day.
  • In the event of a disagreement over the contents or cost of the order between the customer and the delivery driver, we will make every reasonable attempt to resolve the matter to the customer's satisfaction, within two business days.

Security Policy
  • We employ Secure Socket Layer (SSL) technology to protect the transmission of cardholder data to and from our web site.
  • Our SSL certificate has been issue by Thawte, a leader in security.
  • When you navigate to one of our secure (SSL) pages you will see your browser's padlock activated, and security padlock icons may also appear on the page you are viewing.
  • In order to transmit your credit card information through our e-store to our banks, your browser must be able to handle 128-bit encryption (high level of security). This is the same encryption level that banks demand from their customers viewing their personal or business bank accounts using a browser on a personal computer.
  • Using this encryption, information between you, our e-store, and our bank and payment providers are all automatically encrypted (scrambled) when sent and decrypted (unscrambled) when they arrive at their proper destination. This prevents unauthorized persons from reading the data and capturing your credit card number or other personal information.
  • Our company's servers are protected by a firewall and advanced security. We have taken every possible security measure to protect you, our customer.
  • Your credit card number is not stored on our servers.
    There is absolutely nothing more secure than not storing the number. We apologize for the incovenience of having to type the credit card number each time, but this is for your ultimate protection. However, for your convenience we do store the credit card name, type, and expiration date. These are automatically retrieved from our database at the checkout stage of shopping.

Privacy Policy
  • A customer's personal information is stored on our servers only if the customer elects to become a snaxXPRESS member. From the first visit to our store, all member information can be retrieved from our database and displayed for the customer's convenience and speed in ordering. This information includes the credit card type, name and expiration date, but not the credit card number.
  • We offer complete privacy of information to all our customers. We will not provide any information identifying a customer to third parties without the customer's consent in writing or by e-mail.
  • We may provide statistical data about our sales to vendors, but never in a way which may identify our customers without their consent in writing or by e-mail.

Monthly Draw Policy
  • Members that shop ten times at our e-store are automatically entered in our monthly draw. At the end of each month we randomly draw a member from our list of valued shoppers. There is no limit as to how many times a member can be entered for each draw. The draw prizes are announced each month on this page.
